Regarding the 'Max effect', I'd say let them race. If the racer pulls it off! Awesome. If he crashes and burns, hope he'll learn his lesson. If he's just way too dangerous/crazy and endangering himself and others, then hopefully appropriate punishments be given. Most importantly, rules have to be consistently enforced.
I think we've pretty much reached "End-stage" FIA racing rules.
